This Privacy Notice applies to the processing of personal data carried out in connection with registration for and participation in basketball training sessions, camps, events, programs and other activities organized by NBA Basketball School Hungary.

2. Applicable data protection legislation

The processing of personal data is carried out in accordance with applicable data protection legislation, including in particular:

• Regulation (EU) 2016/679 of the European Parliament and of the Council – General Data Protection Regulation (GDPR);

• applicable Hungarian data protection and civil law legislation;

• other applicable legislation relevant to the particular processing activity.

The Data Controller aims to provide information concerning the processing of personal data in a concise, transparent, intelligible and easily accessible manner, in accordance with Articles 12–14 of the GDPR.

3. Purposes of processing

Personal data may be processed for the following purposes:

1. processing registrations for events, camps and training programs;

2. maintaining participant records;

3. organizing and conducting events;

4. communicating with participants and their parents/legal representatives;

5. sending important information, updates and notifications relating to the event;

6. ensuring the safe and appropriate participation of athletes;

7. documenting events;

8. taking and, where appropriate consent has been provided, using photographs and video recordings;

9. preparing and publishing marketing and promotional materials where the required consent has been obtained;

10. establishing, exercising or defending legal claims and complying with legal obligations.

 

4. Categories of personal data

Depending on the event and the registration process, the following personal data may be processed.

Parent/legal representative:

• name;

• e-mail address;

• telephone number;

• billing information where necessary;

• other contact information required for the organization of the event.

Athlete:

• name;

• date of birth;

• age or age group;

• sports-related information necessary for organizing the program;

• other information necessary for registration and participation.

Only personal data necessary for the relevant purpose will be processed.

5. Legal basis for processing

Depending on the particular processing activity, personal data may be processed on the following legal bases:

a) Performance of a contract / steps prior to entering into a contract
For registration, participation and related communication.

b) Compliance with a legal obligation
Where processing is required by applicable law.

c) Legitimate interests
Where processing is necessary for the legitimate interests pursued by the Data Controller, provided that such interests are not overridden by the interests or fundamental rights and freedoms of the data subject.

d) Consent
Where processing is based on consent, such consent must be freely given, specific, informed and unambiguous. Consent may be withdrawn at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

6. Photography and video recordings

Photographs and video recordings may be taken during NBA Basketball School Hungary events.

Such recordings may be used for:

• documenting events;

• presenting and promoting events;

• NBA Basketball School Hungary communications;

• marketing and promotional materials;

• publication on the website, social media platforms and other communication channels.

Where consent is the applicable legal basis for marketing or promotional use, separate consent will be requested.

Refusing or withdrawing consent to optional marketing use of photographs or videos will not affect the athlete's ability to participate in the event, provided that such consent is not necessary for the organization of the event itself.

7. Minors

NBA Basketball School Hungary programs may be attended by minors.

The Data Controller pays particular attention to protecting the rights and interests of children when processing their personal data.

Where processing is based on consent, consent will be obtained from or authorized by the parent or legal representative where required by applicable law.

The GDPR contains specific rules concerning children's consent in relation to information society services. The applicable age threshold may vary between 13 and 16 depending on the Member State concerned.

8. Recipients of personal data

Personal data may be accessed only by persons and service providers whose access is necessary for the relevant purposes.

These may include:

• staff and event personnel;

• coaches and members of the professional staff;

• IT service providers;

• hosting and system administration providers;

• registration and event management service providers;

• accounting and financial service providers;

• marketing and communication service providers;

• legal or professional advisers where necessary.

Personal data will only be disclosed to third parties where there is an appropriate legal basis for such disclosure.

9. International transfers

Where personal data are transferred to a country outside the European Economic Area, the Data Controller will ensure that the transfer is carried out in accordance with the GDPR and that appropriate safeguards are in place.

10. Data retention

Personal data will be retained only for as long as necessary for the purposes for which they were collected.

The retention period depends on the type of data and the purpose of processing.

Where applicable law requires the retention of certain data, such data will be retained for the period required by law.

Where processing is based on consent, the processing will cease following withdrawal of consent unless there is another legal basis for continued processing.

11. Rights of data subjects

Data subjects have the right to:

• request information about the processing of their personal data;

• request access to their personal data;

• request rectification of inaccurate or incomplete data;

• request erasure of personal data in certain circumstances;

• request restriction of processing in certain circumstances;

• withdraw consent where processing is based on consent;

• exercise the right to data portability where applicable;

• lodge a complaint with the competent supervisory authority.

 

12. Withdrawal of consent

Where processing is based on consent, consent may be withdrawn at any time.

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Data subjects have the right to lodge a complaint with the competent data protection supervisory authority.

14. Data security

The Data Controller applies appropriate technical and organizational measures to protect personal data against, among other things:

• unauthorized access;

• unauthorized alteration;

• unauthorized disclosure;

• accidental loss;

• destruction;

• and other unlawful forms of processing.

 

15. Automated decision-making and profiling

The Data Controller does not use automated decision-making or profiling in connection with the processing activities described in this Privacy Notice where such processing would produce legal effects concerning the data subject or similarly significantly affect the data subject.

16. Amendments to this Privacy Notice

The Data Controller reserves the right to amend this Privacy Notice, in particular where required due to changes in legislation, processing activities or services used.
