GENERAL TERMS AND CONDITIONS

NBA Basketball School Hungary

Effective from: 31/08/2026

1. General provisions

These General Terms and Conditions (“GTC”) govern registration for and participation in basketball camps, training sessions, educational programs, matches, sporting events and other programs (“Program”) organized by NBA Basketball School Hungary.

The service provider organizing the Programs is:

Hereinafter: the “Organizer”.

The Organizer and the parent or legal representative registering for a Program are collectively referred to as the “Parties”.

2. Scope of the GTC

These GTC apply to:

  • basketball camps organized by NBA Basketball School Hungary;

  • basketball training sessions and development programs;

  • Skills Camps, Mini Camps, Elite Camps and other sports programs;

  • matches and sporting events;

  • online registration and related services.

Specific information concerning a particular Program, including the venue, date, age group, participation fee and program content, will be provided on the relevant registration page or Program information page.

3. Conclusion of the contract

Registration for a Program takes place electronically.

During registration, the applicant must provide accurate information and confirm that they have read and accepted these GTC.

Submitting a registration does not necessarily constitute acceptance of the application or conclusion of the contract. The contract is concluded when the Organizer accepts the registration and confirms it electronically, provided that all required information has been submitted and places are available.

The Organizer will normally confirm acceptance by e-mail.

The language of the contract is Hungarian, unless the Organizer expressly provides for the conclusion of the contract in English.

 

4. Obligations of the participant and legal representative

Where the participant is a minor, registration must be completed by the parent or legal representative.

The parent or legal representative is responsible for ensuring that:

  • all information provided during registration is accurate;

  • the necessary parental/legal representative consent is provided;

  • the Organizer is informed of any relevant circumstance that may affect the child's safe participation;

  • the child is informed of the rules of the Program and the rules of the relevant sports facility.

Participants must:

  • follow the instructions of coaches and Organizer personnel;

  • comply with the rules of the sports facility;

  • respect the physical integrity and personal rights of other participants;

  • use sports equipment and property responsibly.

 

5. Program content

The Organizer will make reasonable efforts to conduct the Program in accordance with the advertised professional and organizational conditions.

The Organizer reserves the right, where reasonably necessary, to:

  • replace a coach or professional staff member;

  • modify a program time or individual program element;

  • change the venue;

  • make minor modifications to the professional content of the Program.

If a change materially affects the essential characteristics of the Program, the Organizer will inform participants within a reasonable period.

6. Participation fee

The participation fee will be stated on the relevant Program registration page or information page.

The displayed price will clearly indicate whether applicable taxes and mandatory charges are included.

The payment method and deadline will be specified during the registration process.

The Organizer may make participation conditional upon payment of the applicable participation fee.

7. Payment

The participation fee may be paid using the payment methods indicated for the relevant Program.

Where online card payment is available, the transaction may be processed through a third-party payment service provider used by the Organizer.

The processing of personal data relating to payment is governed by the NBA Basketball School Hungary Privacy Notice.

 

8. Cancellation and refunds

Cancellation and refund conditions applicable to a Program will be stated in the relevant Program information and registration materials.

A cancellation request should be submitted to the Organizer in writing by e-mail.

The applicable cancellation and refund conditions must be made clearly available to the participant during the registration process.

Where the consumer has a statutory right of withdrawal or termination, the Organizer will provide the information and procedure required for exercising such right.

9. Right of withdrawal and termination

For distance contracts, consumers generally have a 14-day right of withdrawal without giving any reason, subject to applicable statutory conditions.

For services, the 14-day period generally begins on the date on which the contract is concluded.

Where the consumer expressly requests that performance of the service begin before expiry of the withdrawal period, the specific statutory rules concerning withdrawal will apply.

Any statutory exceptions arising from the nature, timing or performance of the Program will be communicated during the registration process where applicable.

10. Cancellation of a Program by the Organizer

The Organizer may cancel or modify a Program for legitimate reasons, including insufficient registrations, governmental restrictions, force majeure, unavailability of the venue or other circumstances beyond the Organizer's reasonable control.

Participants will be informed as soon as reasonably possible.

Where a Program is cancelled in its entirety, the Organizer will determine the applicable refund arrangements in accordance with the circumstances and applicable law.

11. Illness, injury and health-related circumstances

The participant and their legal representative must inform the Organizer in advance of any relevant circumstance that may affect the safe participation of the participant and which the Organizer is lawfully entitled to know.

The Organizer may refuse participation or temporarily exclude a participant if the participant's condition creates a risk to their own safety or the safety of others.

Health information may constitute special-category personal data and will only be processed where an appropriate legal basis exists.

 

12. Liability

The Organizer will organize and conduct the Program with reasonable professional care.

The Organizer shall not be liable for damage caused by the participant's breach of rules or improper conduct.

The Organizer's liability shall at all times be subject to applicable Hungarian law.

Nothing in these GTC excludes or limits liability which cannot lawfully be excluded or limited.

13. Photography and video recordings

Photographs and video recordings may be taken during the Program.

The detailed rules governing the processing and use of such recordings are set out in the NBA Basketball School Hungary Privacy Notice.

Where required, separate consent will be obtained for marketing and promotional use of photographs and videos.

Refusal to consent to optional marketing use will not in itself prevent participation in the Program where such consent is not necessary for the conduct of the Program.

14. Personal data

The Organizer processes personal data in accordance with applicable data protection legislation, including the GDPR.

The detailed rules concerning the processing of personal data are set out in the NBA Basketball School Hungary Privacy Notice.

The Privacy Notice is continuously available on the website.

15. Intellectual property

The NBA Basketball School Hungary name, logos, graphic elements, texts, methodologies, photographs, videos and other content may be protected by copyright, trademark or other intellectual property rights.

Unauthorized copying, distribution, commercial use or other unauthorized use is prohibited.

Professional or educational materials provided during the Program may only be used for the participant's personal purposes unless otherwise authorized in writing.

16. Complaints

Participants or their legal representatives may submit complaints using the following contact details:

The Organizer will handle and respond to complaints in accordance with applicable law.

In consumer disputes, consumers may contact the competent consumer protection authority or the competent conciliation board.

EU consumer protection rules require appropriate pre-contractual information concerning contractual conditions and available remedies in online consumer transactions.

17. Governing law and disputes

These GTC and the legal relationship arising from them are governed by Hungarian law, subject to mandatory consumer protection provisions.

The Parties shall first attempt to resolve any dispute amicably.

Nothing in these GTC shall restrict any statutory consumer rights or remedies.

18. Amendments

The Organizer may amend these GTC.

Amendments shall become effective from the date of publication or from a later date specified in the amended document.

For contracts already concluded, the version of the GTC applicable at the time of conclusion shall apply unless otherwise required by law or expressly agreed by the Parties.

19. Final provisions

If any provision of these GTC is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Matters not expressly regulated by these GTC shall be governed by applicable Hungarian law, including the Hungarian Civil Code and applicable consumer protection legislation.
